Parking
Public parking is available in designated areas on Washington Street as well as in the public lot behind and to the left of the courthouse. Bring coins for meters.
Pre-Mediation
Small Claims cases are typically heard in Courtroom One on the first floor. Mediators should sit on the far-right seats designated for attorneys.
At the beginning of the session, the clerk will introduce the mediation program and proceed to call the Small Claims docket, offering mediation to the parties in each case.
Metropolitan Mediation Services (MMS) also provides mediation services for Small Claims sessions. Please review the rotation schedule for Newton District Court which can be found in the Neutral Resource section of the Home page in the MWI portal. If MMS mediators are in attendance, introduce yourself and confirm which mediation program is first in the rotation for receiving case referrals that day.
Mediation
There is a small room available on the first floor, directly off the lobby, that is utilized for mediation. If that room is already occupied, check with the Clerk’s Office regarding the availability of the second mediation room downstairs.
Post-Mediation
Bring the file with any agreements reached to the Clerk’s Office where photocopies can be made. Once you have copies made, give one copy of each form (except the ADR Referral Form) to each party. Put one copy of each form (including ADR Referral Form) in the court folder and bring to the clerk who referred you the case. You should always leave court with one copy of each form.
Uploading paperwork: Please add the case information and upload the paperwork under the court case in the portal. If you are having trouble with this step or have mediated multiple cases in one session, please email the scans to MWI at courtmediation@mwi.org.
