Follow these court-specific steps when conducting an in-person mediation
at Newton District Court.
Step 1
Pre-Mediation
Small Claims cases are typically heard in Courtroom One on the first
floor. Mediators should sit in the far-right seats designated for
attorneys.
At the beginning of the session, the clerk will introduce the
mediation program and call the Small Claims docket, offering
mediation to the parties in each case.
If Metropolitan Mediation Services mediators are present, introduce
yourself and confirm which program is first in the rotation for
receiving referrals that day.
Step 2
During Mediation
A small mediation room is available on the first floor directly off
the lobby.
If that room is occupied, check with the Clerk’s Office regarding
the availability of the second mediation room downstairs.
Step 3
Post-Mediation
Bring the case file and any agreements to the Clerk’s Office, where
copies can be made.

Give each party one copy of every completed form except the ADR
Referral Form.

Place one copy of every form, including the ADR Referral Form, in
the court folder.

Return the court folder to the clerk who referred the case.

Leave the courthouse with one copy of every completed form for
MWI’s records.
Add the case information and upload the paperwork under the court
case in the portal. If you have trouble uploading the documents or
mediated multiple cases during the same session, email the scans to
courtmediation@mwi.org.
