Massachusetts Superior Court Mediation

MWI is an approved provider of mediation and arbitration services for the Massachusetts Superior Court.

The Superior Court is a trial court in Massachusetts. The court has 82 justices across 20 courthouses. It can hear either criminal or civil cases, including civil actions over $50,000, labor disputes, and any case where parties are seeking equitable relief. In addition to being a trial court, the Superior Court encourages the use of alternative dispute resolution, mediation, and arbitration. Mediating a Superior Court case allows people to resolve disputes  efficiently and more cost-effectively than trial.


How does mediation in the Superior Court work?

Parties agree to work together, with the assistance of an experienced neutral, to explore their respective interests and generate options for resolving the dispute. The mediator helps to facilitate communication and empowers people to reach a resolution. The mediator, or counsel, can draft an agreement reached in mediation. The mediated agreement can be filed with the Court and then the case will be resolved. Mediation is a flexible process that allows the parties to discuss, in confidence, the issues that brought them to court and to determine the outcome. Mediation is available for cases with and without counsel.

The Superior Court touts that “ADR has been developed because in some cases a non-adjudicatory result is quicker, less expensive and more satisfying.”

  • medical malpractice
  • matters where parties are seeking equitable relief and
  • actions including labor disputes where parties are seeking injunctive relief.
