A "party" is defined as all persons whose interests are shared and/or are represented by one attorney, advocate, or insurance company representative.

Scheduling:

  • Mediation and facilitation services can be scheduled at the earliest possible time convenient for the mediator and the parties (within hours, if needed).

  • Weekend sessions are available for services if requested by parties or required by scheduling limitations.

Postponement:

If a matter is postponed for cause and by agreement 14 days or fewer from the scheduled date, the parties are equally responsible for 100% of all unreimbursed expenses. If postponement is sought by one party, that party is responsible for 100% of all unreimbursed expenses. Payment for reserved professional time will be reviewed case-by-case, considering the timing of the notice of postponement, the cause, professional time up to the notice of postponement, the new date and any pattern of repeated postponements.

Cancellation:

If a matter is cancelled by agreement at or less than ten days from the scheduled date, the parties are equally responsible for 100% of the reserved professional time and all unreimbursed expenses. Cancellation on day 11-15 from the scheduled date is billed at 75% of the reserved professional time and all unreimbursed expenses. Cancellation on day 16-20 of the reserved professional time is billed at 25% of the reserved professional time and all unreimbursed expenses. In addition to scheduled professional time, any time spent in reviewing documents or other preparation in advance of the hearing will be billed to the parties. If only one party is responsible for the cancellation, that party will be billed for 100% of the cancellation fees and expenses.

Expenses:

Parties can expect there will be no additional fees unless informed in advance by MWI.  All costs for conference calls, phone calls and travel costs (e.g. airfare, accommodations, meals, etc.) will be billed directly to the parties, without mark-up, as incurred.

Billing:

Fees and costs will be due at the beginning or conclusion of the proceeding unless other arrangements have been made.  Any additional professional time will be billed to the parties equally, subsequent to the scheduled mediation or arbitration.

Non-profit organizations and income-eligible individuals are encouraged to inquire into MWI's reduced rates for services and training.
